1. Introduction

Welcome to the American Institute of Building Science (“AIOBS,” “we,” “our,” or “us”). By accessing or using our services, including residential and commercial building evaluations, energy audits, and duct testing, you agree to comply with and be bound by these Terms & Conditions (“Terms”). If you do not agree with these Terms, you may not use our services.

2. Services Provided

AIOBS specializes in professional building science services, including but not limited to:

  • Duct Leakage Testing – Assessing air leakage in HVAC systems to improve efficiency and indoor air quality.

  • Energy Audits – Evaluating energy consumption and recommending measures to optimize energy use in residential and commercial buildings.

  • Healthy Home Evaluations – Identifying factors that affect indoor air quality, moisture, and overall occupant health.

All services are provided for educational and evaluative purposes. Recommendations are based on standard building science practices and measurements conducted on-site. Users are responsible for implementing any suggested improvements.

3. Eligibility

To use AIOBS services, you must be at least 18 years old or have legal consent from a parent or guardian.

4. Registration and Scheduling

Some services may require scheduling an on-site evaluation or creating an account for reporting purposes. You are responsible for providing accurate property information and access for evaluation.

5. Payment and Refunds

All fees are due as specified at the time of booking or registration. Refunds are at the sole discretion of AIOBS and may be subject to our refund policy.

6. Intellectual Property

All reports, recommendations, software, and training materials provided by AIOBS are the intellectual property of AIOBS or its licensors. Users may not copy, distribute, or reproduce these materials without prior written consent.

7. Insurance Coverage

AIOBS maintains insurance coverage to support its operations:

Workers’ Compensation & Employers Liability

  • Statutory workers compensation benefits in compliance with Nevada law, covering medical expenses, lost wages, rehabilitation, and death benefits where applicable.

  • Employers Liability Limits:

    • Bodily Injury – Each Accident: $100,000

    • Bodily Injury by Disease – Each Employee: $100,000

    • Bodily Injury by Disease – Policy Aggregate: $500,000

  • Blanket Waiver of Subrogation for Nevada operations as required by written contracts.

Commercial General Liability

  • Coverage for bodily injury, property damage, and personal/advertising injury arising from ongoing operations.

  • Limits:

    • Each Occurrence: $1,000,000

    • General Aggregate: $2,000,000

    • Products/Completed Operations Aggregate: $2,000,000

    • Personal & Advertising Injury: $1,000,000

    • Damage to Premises Rented: $100,000

    • Medical Payments: $5,000

  • Key endorsements include Additional Insured coverage and Waiver of Subrogation in favor of designated parties for ongoing operations.

Commercial Automobile Liability

  • Liability coverage for owned business vehicles, including:

    • Combined Single Limit (CSL) Liability: $1,000,000

    • CSL Uninsured Motorist: $1,000,000

    • Medical Payments: $2,000

  • Physical damage coverages such as comprehensive, collision, emergency road service, and rental reimbursement are not included.

8. Limitation of Liability

By using AIOBS services, you acknowledge and agree that:

  1. AIOBS provides building evaluation services “as is” and makes no guarantees regarding energy savings, health improvements, or system performance.

  2. AIOBS is not responsible for any property damage, personal injury, or other loss arising from participation in services, use of recommendations, or actions taken based on evaluations.

  3. Liability for any claim related to AIOBS services is limited to the fees paid for the specific service in question.

9. Indemnification

You agree to indemnify, defend, and hold harmless AIOBS, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to conflict of law principles.

11. Modifications

AIOBS reserves the right to update or modify these Terms at any time. Changes are effective immediately upon posting on our website. Continued use of services constitutes acceptance of the updated Terms.
